User Agreement

Welcome to www.kaplanaccaonline.com (the "Site"). Please read this User Agreement carefully before accessing or using your Kaplan ACCA Online access. By accessing or using online materials, products or services, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you may not access or use your Online Account. Kaplan may modify this Agreement at any time and such modifications shall be effective immediately upon posting of the modified Agreement. You agree to review the Agreement periodically to be aware of such modifications and your continued access or use of Online Access shall be deemed your conclusive acceptance of the modified Agreement.

Student Registration

Registration with ACCA is the responsibility of the individual student.

Geographic Availability

Kaplan ACCA Online purchase is only valid for students residing in South East Asia only.

Course Confirmation

Course enrolment will only be confirmed upon receipt of payment.

Taxes

All fees quoted are exclusive of GST unless otherwise stated. Candidates who are residing in Singapore are required to pay GST.

Privacy Policy

Please review our Privacy Policy, which is a part of this User Agreement and describes how Kaplan Financial handles any personal data collected from visitors to this Site.

Copyright and Licenses

Kaplan ACCA Online materials and products are protected by the laws of copyright of the Republic of Singapore and other countries throughout the world. Unauthorized reproduction of these materials and products, or portions thereof, in any form whatsoever, is strictly prohibited.

Kaplan ACCA Online materials and products which you have purchased are to be used for your own personal use and benefit. Unauthorised commercial resale of any such materials and/or products, whether in any online or offline form is prohibited, and all rights are reserved accordingly.

Shared use of the Site’s question bank or other materials or products is prohibited. Kaplan ACCA Online materials and products are intended for personal use only. Sharing or selling Kaplan ACCA Online access is prohibited. All online access is non-transferable.

The entire contents of the Site and its materials, products and services are copyrighted under the Republic of Singapore copyright laws and those of other jurisdictions. The owner of the copyright is Kaplan or in certain cases other Kaplan group companies. You may print materials solely for your own non-commercial use. Any other copying, redistribution, retransmission or publication of any such eLearning materials, products or services is strictly prohibited. You agree not to change or delete any proprietary notices from materials downloaded. You agree that you shall have no recourse against Kaplan, or other Kaplan group of companies, for any alleged or actual infringement or misappropriation of any proprietary right in your communications to us.

Use of Online Access

You understand that Kaplan does not warrant that this Online Access will be uninterrupted or error-free. Online Access to the Site is provided on an "as is, as available" basis. You agree to meet the minimum system requirements set forth for the Site.

You understand that Kaplan may revise the content of its website and online materials, products or services from time to time to meet its training objectives. It may add or remove materials, products or services that it considers as unnecessary or no longer relevant for exam preparation. Once the materials, products or services are removed, they will not be accessible and will not be available upon request.

You understand that your subscription to the Site is a limited non-exclusive license to use the applicable content you have subscribed to only between the time access is granted and the exam date for your subscription purchase. To the extent any copyright in any materials, products or services is owned by Kaplan group companies other than Kaplan then Kaplan acts as agent of such companies, for the purpose of granting this license to you, as well as principal in the case of the license granted in respect of its own materials, products and services. The subscription is non-transferable and is to be used only by you. You will not share the username/user id and password with anyone, even if that person has his or her own subscription to the Site. Such sharing of usernames/user ids and passwords is a violation of this Agreement and will result in immediate suspension of your privileges to the Site without refund. Kaplan monitors its website, including the use of Online Access, for visitors and enforces its one subscriber-one user policy diligently.

In no event will Kaplan, or other Kaplan group of companies, be liable for (I) any incidental, consequential or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information and the like) arising out of the use of or inability to use the Site, or any information, or transactions provided on or downloaded or hyperlinked from the Site, even if Kaplan or its authorized representatives have been advised of the possibility of such damages; or (II) any claim attributable to errors, omissions or other inaccuracies in Kaplan’s electronic content and/or materials or information downloaded through, or hyperlinked from the Site.

Trademarks

KAPLAN FINANCIAL, the Kaplan Financial Logo, and any other Kaplan trademarks on this Site are trademarks owned by Kaplan Financial or other Kaplan companies (collectively, “Kaplan Financial Trademarks”). You may not use the Kaplan Financial Trademarks in connection with any product or service that does not belong to us, or in any manner that is likely to cause confusion among users about whether Kaplan or we are the source, sponsor, or endorser of the product or service, nor in any manner that disparages or discredits Kaplan or us.

Links, Frames, and Metatags

You may link to the home page of the Site as long as the link does not cast us in a false or misleading light. Please let us know if you link to the Site by contacting us at accaonline@kaplan.com. You may not frame the content of the Site. You may not use metatags or any other “hidden text” that incorporates the Kaplan Financial Trademarks or our name without our express written consent.

Links to Other Web Sites

This Site may contain links to other Web sites, including the sites for Kaplan Financial and its parent companies, subsidiaries or related companies. This User Agreement and the Privacy Policy do not apply to these other Web sites. Be sure to read the user agreements and privacy policies that govern your use of these other Web sites.

Indemnification

You agree to indemnify, defend, and hold harmless to Kaplan and its parent companies, subsidiaries, related companies, agents, investors, suppliers, officers, directors, employees and any third party information providers to Kaplan and/or Kaplan eLearning from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement by you.

Miscellaneous

This Agreement shall be governed and construed in accordance with the laws of the Republic of Singapore applicable to agreements made and to be performed in the Republic of Singapore. You agree that any legal action or proceeding for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in the Republic of Singapore. Any cause of action or claim you may have with respect to Kaplan eLearning must be commenced within one year after the claim or cause of action arises or such claim or cause of action will be barred. Kaplan’s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Kaplan may assign its rights and duties under this Agreement to any party at any time without notice to you.

Termination

We reserve the right to suspend the Site or terminate this User Agreement at any time without notice for any reason, including, in the case of the User Agreement, for your violation of any of its provisions. The Disclaimer and Limitation of Liability and Governing Law sections of this User Agreement shall survive any such termination.

Kaplan reserves the right to change the terms and conditions without prior notice. Please review the website periodically.

In all circumstances (except where prohibited by law), Kaplan and its group of companies’ liability to an individual subscriber will be limited in aggregate to the amount of fees received by it from the relevant subscriber with respect to Kaplan ACCA Online.

Discounts and Promotions

Kaplan Financial reserves the right to vary, amend or discontinue any or all of the discounts as it deems appropriate.

Lecturers

Kaplan Financial reserves the right to vary or cancel any of the courses described or alter the composition of the relevant lecturing team should the circumstances so require.
